Legal Separation In Florida, Naples Family and Divorce Lawyer, Malignant Divorce

Even though you and your spouse may be at odds or you no longer want to be in a marriage together, divorce may not necessarily be the next best step for you. Here are some reasons why getting a traditional divorce may not be your best option and how to get the legal help you need when dissolving your marriage is on the horizon.

You Need Your Spouse’s Health Insurance

If you are on your spouse’s health insurance, you will lose your coverage if you get a divorce. You may be eligible for other insurance coverage, like COBRA, but typically this is expensive and doesn’t offer as many benefits. In this case, a legal separation may benefit you more than a divorce. You remain married on paper but are able to live separate lives as though you were indeed divorced.

You Do Not Have Enough Income to Live Independently

If you are a lower-earning spouse, getting a divorce right away may leave you with little to no financial resources as you go through the process of dissolving your marriage. You may want to take some time before exploring your options to obtain additional vocational training or apply for new jobs. This way, you have a little bit of a windfall when it begin.

You’re Not Able to Afford Traditional Divorce Litigation

If you and your soon-to-be-ex-spouse are getting a divorce and can’t afford traditional litigation, you may have the option of mediation.

Mediation allows you and your spouse to meet with a neutral third party to work out issues like child custody and property division and can help you reach compromises that work for everyone involved. Then, once an agreement has been reached, your attorney can file it with the appropriate Florida court to be finalized.

Mediation Is Untenable

If you are not able to communicate with your spouse without the situation becoming hostile and turning into an argument, mediation may not be tenable for you. In this case, arbitration may be an option. Arbitration involves a private judge hired by you and your spouse who will make decisions about your case similar to a divorce hearing without the extra publicity.
